The website available at www.captain-bob.com (hereinafter, the “Site”) is published by CAPTAIN BOB SAS , with capital of 19,000 euros, whose address is 6 Place Wilson 31000 TOULOUSE , registered in the Toulouse Trade and Companies Register under number 930067756 , (hereinafter, “captain-bob”). The publication director is Souad REZKALLAH.
The Site and Application are hosted by IONOS SARL (7, place de la Gare, BP 70109, 57200 Sarreguemines Cedex, 431 303 775 RCS Sarreguemines, tel. 0970 808 911, info@IONOS.fr)
These general terms and conditions of use (hereinafter, the “GTCU”) apply to the entire content of the Site and Application (hereinafter, together, the “Interfaces”) as well as to all Services.
You may obtain any information relating to the use of or access to the Services by contacting captain-bob at contact@captain-bob.com or via the help section available on the Interfaces.
Use of the Interfaces and Services by Members is subject to validation of the GCU in force at the time of their registration on the Application.
Use of the Interfaces by Users implies full acceptance of the provisions of the GCU applicable to them and in force at the time of access to the Site.

DEFINITIONS
“Application” refers to the mobile application captain-bob.app published by CAPTAIN BOB SA accessible via browsers, and can be installed on a device’s home screen via the browser, just like a native application.
” CAPTAIN” designates a Member (=a creator), a natural person of legal age who creates and publishes an activity (called an “Experience”) on the application. His/her role is to publish an activity in order to carry it out in a group with other members.
The Captain and Carpooling: The Captain can be the owner of a car (4-wheeled motorized land vehicle).
If he/she proposes the carpooling option for his/her activity, he/she must absolutely :

  • Valid driver’s license.
  • Valid car insurance.
  • Make sure your insurance covers any passengers taking part in the carpool (whether other participants or additional drivers).

Important: The Captain who offers carpooling does so in a private capacity; he is not a professional driver.

“BOB” refers to the Member (=participant), a non-professional natural person of legal age who applies to participate in an Experience as a participant/passenger.
The BOB may own a car (4-wheeled land motor vehicle).
If he/she organizes a trip related to an Experience in which he/she is participating or offers the carpooling option for said Experience in which he/she is registered; he/she must absolutely :

  • Valid driver’s license.
  • Valid car insurance.
  • Make sure your insurance covers any passengers taking part in the carpool (whether other participants or additional drivers).
    Important: The Bob who offers carpooling does so in a private capacity; he is not a professional driver.
    “Member” means a registered user, i.e. any person who has created an account on the application. The Member acts in a private (non-professional) capacity.
    “User” refers to the Visitor, i.e. any person who consults the Site, without necessarily having an account.
    “Publication” Publication is the process by which the Captain informs other Members (the BOBs) of the activity he wishes to organize.
    “Experience” refers to the activity published by a CAPTAIN. It includes an activity, a location of the activity, a number of participants, a fee or no fee, a carpool or not attached to the said Experience.a theoretical itinerary (Departure Point to Arrival Point).
    “Carpooling (optional) The Captain can choose to add a carpooling offer to his activity to facilitate the mobility of participants. This involves organizing the actual car journey between the Meeting Point and the Experience Practice Point.
    “The Captain/Bob indicates the Participation Fee (the flat-rate cost per kilometer) that passengers will have to share.
    The Captain-bob application is not responsible for participation fees.
    Read: Clause on the Free Service (No Commission)
    “Inconvenience” refers to any delay, postponement or cancellation by a Captain or a Bob made at least within the time period determined by captain-bob and notified to the Members before the creation of a Route before the departure time scheduled between the Members or confirmed and accepted by the other Member.
    “Starting Point” means the theoretical starting point of the Publication/Activity.
    “Point of Arrival” means the place of theoretical completion of the Publication/Activity.
    “Meeting Point” refers to the meeting place between the Captain (creator of the activity) and the BOB: participant in the activity.
    “Stopover” refers to the location of a stopover on the Route, when a carpool is proposed for an Experience by the Captain or the Bob.
    “Services” refers to all services offered by captain-bob and/or facilitated by the services.
    “Route” means the actual route taken by the Captain and the Bob from the meeting point to the drop-off point.
    “Verification by telephone” means the operation of verifying the joint journey of the Driver and Passenger carried out during the Trip.
    “Verification by the server” means the operation of verifying the joint journey of the Driver and Passenger carried out after the Trip has been completed.
    “Verifications” means Telephone Verification and Server Verification. PRESENTATION OF SERVICES

Through its interfaces, captain-bob offers Members the opportunity to publish an activity they have organized, and share it with others. The application can also be used to arrange a shared journey to the activity.
Users meet virtually to agree on a common Route. Together, they define their individual Routes based on the information in the Publication, such as Activity, Departure, Meeting, Drop-off and Arrival Points, as well as desired departure times. These arrangements take into account personal criteria (smokers or non-smokers, presence of pets, etc.) and are validated by the mutual agreement of the Members concerned.
Captain-bob also enables Members to communicate with each other, before and after the Trip. They can leave reviews of other Members following a Trip and reply to comments on the interfaces.
Captain-bob can also provide Members with information and publish articles via its interfaces.

ACCOUNT CREATION AND ACCESS TO SERVICES

The GCU are deemed to have been concluded between the Member and captain-bob as of the Member’s registration on the Application and until they are terminated by either party under the conditions set out in article 12 of the GCU.

Conditions of access to the Interfaces and Services
The creation of an account on the Interface under the conditions mentioned in the article below (hereinafter, the “Account”) is a prerequisite for the Member to be able to access/use the Services.
Once the Application has been downloaded and the Account created, and provided that the Member is logged in to his/her Account, the Member can access all the Services offered by captain-bob on the Interfaces, and in particular agree with other Members on Routes and Journeys or interact with other Members, receive information, etc.
The equipment (computers, smartphones, tablets, software, telecommunications, etc.) used to access the Interfaces and Services are the responsibility of Members, as are the communications costs incurred by their use.

Creation of an Account
The creation of an Account is carried out without financial consideration on the part of the Member, is reserved for any person aged at least 18 years and enjoying the full exercise of their civil rights, and is subject to acceptance of the GCU. Only one account may be created per e-mail address. captain-bob reserves the right to suspend any Account in the event of multiple creations by the same individual.
After downloading the Application via download platforms that allow it, an Account is created by filling in a form that includes mandatory fields (e.g. first name, last name, e-mail address, telephone number and password), or by associating data from a pre-existing account on a third-party service such as Google, Facebook… (other data may then be communicated by this third party, such as identifiers and photographs) to the Application.
Account verification can be carried out once the Application has been installed by the Member via the “verify my account” tab, using the e-mail address or telephone number provided by the Member at the time of registration.
The Member agrees to provide only accurate and truthful personal information and data. In particular, he/she agrees not to impersonate another person and to inform captain-bob without delay in the event of any modification to the information and personal data he/she provided at the time of registration and, if necessary, to make said modifications him/herself within the profile management area provided for this purpose within the Interfaces.

Identifier and password
When creating an Account, the Member must choose his or her own e-mail address or, if applicable, cell phone number and password (hereinafter referred to collectively as the “Identifiers”), and mention his or her telephone number. The Identifiers must be sufficiently secure and are transmitted to captain-bob in a secure manner.
The Member’s first name and the initial of his/her last name (the “captain-bob Identity”), to the exclusion of the full real identity, are made public in the Application for the purposes of the Services.
Captain-bob offers the Member the possibility of choosing any username, in compliance with legal provisions, the GCU and other Members. Nevertheless, captain-bob encourages its Members to use their real identity, in particular to facilitate the meeting between the Driver (The Captain) and the Passenger (The Bob). In any case, captain-bob reserves the right to refuse the registration of a Member and/or to make it subject to the correction of his/her user name.
It is the Member’s responsibility to keep his/her Identifiers confidential. The Member is solely responsible for the use of his or her Account and Identifiers. Any use of the Services, connection or transmission of data carried out via the Member’s Account with his or her Identifiers will be presumed to have been carried out by the Member and under his or her exclusive responsibility, unless a written and duly motivated denunciation is sent to captain-bob by registered letter with acknowledgement of receipt to the following address X..
Captain-bob cannot be held responsible for the loss of one or more Identifiers and, in the absence of prior written opposition from the user, for the damaging consequences of the use of the user’s Account by an unauthorized person.
captain-bob, which has no control over the veracity of the information transmitted by Members for the creation of an Account, cannot be held responsible for false declarations or usurpation of identity by Members.

MEMBER COMMITMENTS

Members undertake to use the Services for strictly personal purposes in accordance with the purpose of the Services, and not for commercial or professional purposes. Any activity which, due to the nature of the journeys, their frequency, or the number of passengers transported, would result in a profit situation for the Driver may be considered as professional. To this end, captain-bob does not interfere in the Routes other than through the Optimization suggested to the Members, the schedules, nor in the acceptance of the Passengers or the Driver.

In order to guarantee optimal operation of the Service, Members undertake to (i) have their mobile terminal in active working order, (ii) have an active 3G/4G rate plan, (iii) have set their mobile terminal to regularly communicate their geolocation information to the Service.

Driver’s commitments
The Driver undertakes to :
Use their personal vehicle or, if their vehicle is a company car paid for by their employer, indicate this information in the Application so that, where applicable, the Service does not invoice the Passenger for any Travel Expenses;
Operate a 4-wheeled motorized land vehicle in perfect working order and maintain it in accordance with customary practice and safety regulations;
Respect the Route agreed with the Passengers, and in the absence of any agreement to the contrary between the Members, go to the Meeting Point and the Drop-off Point agreed between them;
In the event of inability to reach the Meeting Point at the scheduled time, to inform Passengers, without delay and free of charge, of any Announced Impediment and, outside of any Announced Impediment, to contact Passengers directly to inform them;
Find out about your insurance coverage;
Upon request by the Passenger, present his/her valid driving license and insurance policy covering damage to third-party passengers in the event of accident(s);
Not to use the Services as part of a professional transport activity or any other profit-making activity. Consequently, it is not required to fulfil the obligations of a carrier and the Passenger cannot expect such a service to be provided.
Respect the maximum number of people in its vehicle as set out in the captain-bob health instructions/guide to good conduct during the period of circulation of the Covid-19 virus.
In the event of measures taken by the health authorities: Wear a protective mask during the Journey during the period of circulation of the Covid-19 virus.

Bob commitments (participants)
Bobs or participants agree to :
In the absence of any agreement to the contrary between the Members, go to the Meeting Point set with the Driver at the time agreed with the latter;
In the event of inability to reach the Meeting Point at the scheduled time, inform the Driver, without delay and free of charge, of any Inconvenience or, in the absence of any Inconvenience, contact the Driver directly to inform him;
Check that the Driver has valid motor insurance covering the Passenger in the vehicle, as well as a valid driving license and all the documents required to drive the vehicle;
Adopt appropriate and respectful behavior during the activity. Not to hinder the Driver’s concentration or diminish the safety of the Trip, and in general not to disturb the Driver’s driving;
Respect the cleanliness of the Driver’s vehicle during the Trip.
Carry out the Verification by telephone when boarding the Driver’s vehicle during the Trip.
Wear a protective mask during the Trip while the Covid-19 virus is circulating.

COURSE OF THE ACTIVITY

As part of the Services, Members are informed on the Interfaces that their recurring publications are used for optimization purposes for future publications or journeys.
In the event of Optimization, the Members concerned are informed of the Captain-Bob Identity of other Members likely to be interested in their Publication as part of an activity.
Each Member, in his or her capacity as Driver or Passenger, has the possibility of making a proposal to another Member suggested by a Route through Optimization.
The Member contacted may then accept the proposed Route. The reservation is effective when the Members concerned have concurrently validated the Trip.
At any time prior to departure, both Members may cancel or modify the departure time.cf
At the time of departure, or when a Member declares that he/she has started the trip, the GPS system on the mobile terminal of each Member concerned is automatically activated to enable the Passenger(s) to detect the Driver’s arrival on the map, and vice versa, provided that this system is activated and available, and that the Application’s alerts are authorized with the terminal concerned. Location data collected during the trip is used by captain-bob to carry out Verifications. The GPS system on the mobile terminal of each Member concerned is deactivated at the end of the trip.
The activity is considered completed when the Members concerned have indicated this in the Application by clicking on COMPLETED. In any event, the PUBLICATION will be deemed to be COMPLETED 4 hours after the scheduled arrival time at the Arrival Point initially planned by the Members.
In the absence of an announced COUNTER-TIME, the Route is deemed to be validated and the Members concerned must inform each other directly and/or contest the Route with captain-bob within 48 hours of the day of the Route in order to request a possible refund at the following address: contact@captain-bob.com.
In the event that the Members of a given Route are unable to meet up to complete the Route, they may contact each other directly via a mobile terminal before, during and after the Route. To this end, their telephone numbers may be made available to the Member(s) concerned.

VERIFICATION

As part of the invoicing of the Passenger’s share of the Journey Costs and the payment of the Journey Costs to the Driver, captain-bob carries out the Verification by phone and the Verification by server.
Verification by phone
After the start of the journey and before the end of the Journey, the Passenger must ask the captain-bob application to carry out the Verification by phone. To do this, they must press the “Verify” button in the interfaces. A pink/green banner informs the user of the success of the telephone verification.
Server verification
Server verification is carried out by captain-bob after the end of the journey, using the location data from the Passenger’s and Driver’s telephones.
Without successful telephone verification and server verification, the Passenger’s share of the Journey Costs will not be debited and the Driver’s share of the Journey Costs will not be credited.

INTELLECTUAL PROPERTY

Rights held by captain-bob.com
The Interfaces and their contents (hereinafter, the “captain-bob.com Contents”) are the exclusive property of Happy Moov SL or their respective owners.
It is forbidden to modify, copy or reproduce captain-bob.com’s Content without its prior written authorization.
The trademarks and logos, graphics, drawings, photographs, animations, videos and texts accessible on the Interfaces are the exclusive property of captain-bob or their respective owners and may not be reproduced, used or represented without the express authorization of captain-bob or their owners, under penalty of legal action.
In particular, Users and Members shall refrain from modifying, copying, reproducing, downloading, disseminating, commercially exploiting and/or distributing in any way whatsoever and for any purpose whatsoever the pages of the Interfaces or any other element of the Interfaces (software, visual or sound elements, etc.) as well as the computer codes of the elements making them up.

Rights held by Members
As part of the use of the Services, captain-bob.com allows Members, provided they are logged into their Account, to interact with each other and to publish content through the Application such as, in particular, questions, answers, photographs, opinions and comments (hereinafter, “Member Content”).
Member Content belongs to their respective authors and may not be modified, copied, extracted or distributed without their prior written authorization. In any case, the Members’ Content is put online or accessible under the exclusive responsibility of the latter.
Each Member grants captain-bob a license to use, modify and reproduce, for commercial or non-commercial purposes, the Members’ Content, provided that the Content is anonymized. This license is granted on an exclusive basis and without financial consideration, for the entire world and for the duration of the copyright protection applicable to the Member’s Content.

NON-CONFORMING USE

Captain-bob.com reserves the right to temporarily or permanently suspend any Account of a Member or User whose use or behaviour is proven or suspected to be contrary to the GCU (hereinafter, “Prohibited Non-Conforming Uses”).
Captain-bob cannot be held responsible for the consequences of such a suspension. In particular, captain-bob.com reserves the right not to pay out the prize pool of a Driver whose account has been suspended. Non-compliant Uses include, but are not limited to:
The use of several different Accounts by the same person.
A disproportionate number of journeys that do not pass server Verification.
A disproportionate number of Passenger failures to comply with the commitments described in the paragraph “Passenger Commitment”
A disproportionate number of Driver failures to comply with the commitments described in the paragraph “Driver Commitment”.

PROHIBITED CONTENT

In accordance with the provisions of article 6 of the LCEN, captain-bob.com acts as a host for content published by Members and made accessible through the Services. captain-bob is under no general obligation to monitor information created, transmitted and/or stored by Members when using the Services. In particular, captain-bob.com shall not be held responsible for the nature and content posted by Members, nor for any opinions or comments posted by Members, except in cases provided for by the LCEN.
Any Member may alert captain-bob.com to the presence of Prohibited Content on the Interfaces or within the framework of the use of the Services.
Prohibited comments, messages and activities
Each Member undertakes to respect the regulatory provisions of French law in force and in particular, but without limitation, the regulations relating to intellectual property rights and defamatory or insulting comments. captain-bob.com reserves the right to promptly remove any content that is proven or suspected to be illicit or contrary to the GCU (hereinafter, the “Prohibited Content”). captain-bob cannot be held responsible for such removal. Prohibited Content includes, but is not limited to: harmful, threatening, abusive, harassing, vulgar, obscene, invasive of another’s privacy, hateful, racist, anti-Semitic, xenophobic, revisionist, Holocaust denying, abusive, defamatory, violent, pornographic, war crimes, crimes against humanity, denigrating, or other content;
Comments or content that undermine the authority of justice, trials or the presumption of innocence;
Transmission of any message whose content the Member is not authorized to disseminate, including but not limited to confidential information, or whose dissemination would violate the rights of third parties, in particular intellectual property rights or image rights;
Transmission of promotional messages not authorized by the GCU ;
Proposals likely to harm captain-bob.com and its managers, employees, suppliers, customers, shareholders and/or partners, or its reputation or that of its managers, employees, suppliers, which would be contrary to the laws and regulations in force in France, would undermine public order and morality or the rights of third parties;
Proposals whose purpose is to offer commercial services, without the prior consent of captain-bob.com.
Furthermore, it is prohibited for a Member to create accounts other than the one initially created, under his/her own identity or that of a third party, without having obtained prior authorization from captain-bob. Failure by a Member to comply with this prohibition may result in the immediate suspension of the Member’s accounts and all Services.

Declaration of unlawful content
Any User or Member who becomes aware of any Prohibited Content, proven or suspected, in the context of the use of the Services must declare it without delay, in compliance with the provisions of article 6 of the LCEN, using the contact form provided in the Application, indicating :
For natural persons: surname, first name, profession, place of residence, nationality, date and place of birth;
For legal entities: its form, its name, its registered office and the body that legally represents it;
A description of the disputed facts and their precise location;
The reasons why the content must be withdrawn, including a mention of the legal provisions and justification of the facts;
A copy of the correspondence sent to the author or publisher of the disputed information or activities requesting their interruption, withdrawal or modification, or justification that the author or publisher could not be contacted.
It is reminded that the fact of presenting a content or an activity as being a Prohibited Content with the aim of obtaining its withdrawal or to stop its diffusion by knowing this inaccurate information is punished by one year of imprisonment and 150.000 euros of fine.

PERSONAL DATA
As part of the use of the Services by Members, captain-bob may collect and process certain personal data relating to Members. By using the Services, Members acknowledge that they have read the captain-bob.com Privacy Policy.

RESPONSIBILITY

Captain-bob offers a service that connects Drivers and Passengers by publishing activities that include shared rides. It is the responsibility of each Member to check the suitability of the suggestions to their needs and to validate the choices of Members suggested to participate in an activity including the journey.
Consequently, Members are solely responsible for the consequences resulting from their use of the Services, including any damage resulting from accidents occurring during activities or Journeys.
Within the framework of the use of the Services and the actual progress of the Activities + Trips, captain-bob.com is in no way responsible, on any grounds whatsoever :
The smooth running of the Activity or the conditions under which the Activity is carried out;
The smooth running of the Trip or the conditions under which the Trip is carried out;
Damages resulting from the failure of the Driver’s insurance to cover third-party Passengers transported in the event of an accident during an activity or a Trip, or both;
Damages of any kind, direct or indirect, resulting from the use of the Services, including any operating loss, loss of revenue, profits, contracts, business partners or anticipated savings;
The improper performance or non-performance by Members of their respective obligations, in particular under the GCU and its consequences;
Non-payment by Members of Trip Costs or the use of fraudulent means of payment when using the Services;
An Announced Impediment or any other cancellation of a Route by a Member;
Any fraudulent behavior and/or misconduct on the part of Members in using the Services;
Omissions and/or errors relating to the content of the pages of the Interfaces and the use that may be made of them by Users, Members or third parties.
Captain-bob.com makes every effort to ensure that the information it publishes on the Interfaces is accurate and up to date, and reserves the right to correct the content at any time and without notice. However, captain-bob.com cannot guarantee the accuracy, completeness, veracity or absence of modification by a third party.
Furthermore, Members are solely responsible for the confidentiality of access to the Interface on their terminals.
The Interface includes links to other websites or other external sources published by third parties. Insofar as captain-bob cannot control these external sources, it cannot be held responsible for the availability of these external sources, and cannot be held responsible for the content, advertising, products, services or any other material available on or from these external sources. Furthermore, captain-bob cannot be held responsible for any damage or loss, proven or alleged, consecutive or in relation to the use of goods or services available on these external sources.
The Member is informed that captain-bob.com may be required to disclose any Content in order to comply with applicable laws or if, in good faith, captain-bob.com believes that such action is necessary, particularly in the context of legal proceedings, notably to enforce the GTU, to respond to complaints and/or claims alleging infringement of the rights of third parties, to protect its rights or interests, its Members, or the public, without this list being limitative.
The Services are provided “as is”. Captain-bob cannot be held responsible for any deterioration of the Member’s software or for any piracy of which the Member is a victim as a result of using the Services and which is not directly attributable to a fault on the part of captain-bob.

INTERFACE AVAILABILITY

Captain-bob.com will do its utmost to ensure that Users and Members have access to the Interfaces and Services at all times.
The operation of the Interfaces and Services may be temporarily interrupted, including in cases of force majeure, planned or unplanned maintenance, technical updates or improvements, emergency repairs to the Interfaces, to change its content and/or presentation, or due to circumstances beyond the control of captain-bob. captain-bob undertakes to take all reasonable measures to limit such disruptions insofar as they are attributable to it and/or the consequences thereof.
captain-bob is in no way responsible for the unavailability of the Interfaces and/or Services, for the non-operation, impossibility of access, suspension or interruption of the Interfaces or Services, or for poor conditions of use of the Interfaces and/or Services, for any reason whatsoever, and cannot be held responsible for direct or indirect damages of any nature resulting from these facts.
In all cases, and without prejudice to what has just been stated above and in article 9, any possible cause of liability that could be held against captain-bob will only give rise to the payment of damages, the amount of which will be limited to the amounts collected by captain-bob.

MECHANISM FOR VALIDATING FINANCIAL CONDITIONS

The Member enters his/her credit card and bank account numbers in the “Payment method” tab, enabling payment to be received or made when placing an order for a specific Trip. By entering his/her bank account number, the Member declares that he/she accepts the general conditions of use of our banking service provider: CGUS of Mangopay
For each Trip, captain-bob debits the Passenger for his/her share of the Trip Costs at the time of the order and makes a transfer to the Driver’s account at the end of the Billing Period including the Trip.
In the event that a Member makes Trips as both Driver and Passenger during the same Billing Period, captain-bob may, at its discretion, offset all or part of the amounts to be paid and the amounts to be collected. captain-bob will not pay a Driver less than €4.00. If this threshold is not reached during the same billing period, the amounts will accumulate over the following period(s) until the threshold is reached.

TERMINATION
The GCU constitute a contract between the Member and captain-bob that the parties may terminate at any time.
In particular, captain-bob is authorized to automatically delete a Member’s Account in the event of a breach by the Member of any of his or her obligations under the GCU.
In the event of non-compliance with any of the stipulations of the GCU by the Member, captain-bob may automatically, without notice and without any compensation, and without prejudice to any other remedies at its disposal, suspend the provision of all or part of the Services, and in particular access to the Interfaces, close the Member’s Account and block any new registration request on his/her part, and/or terminate the GCU.
This exclusion measure is without prejudice to any criminal or civil proceedings that the Member may be subject to from public authorities, third parties or even captain-bob in the event that the Member’s behavior has harmed its interests.

GENERAL

Validity of the GTU
If any part of the GTU should prove to be illegal, invalid or unenforceable for any reason whatsoever, the term or terms in question shall be declared non-existent and the remaining terms shall retain their full force and scope and continue to be enforceable. The terms declared non-existent will be replaced by terms that most closely resemble the content of the cancelled clause and the original intention of captain-bob.
Applicable law
The GCU are governed by French law.
In the event of a dispute regarding the meaning of a term or provision of the GCU, the Member or User may contact captain-bob by registered mail with acknowledgement of receipt at the following address: Captain-bob, 6 Place Wilson 31000 TOULOUSE.
In the event of a dispute, captain-bob and the Member or User will endeavour to find an amicable solution.
Jurisdiction clause
Any dispute arising from the GTU which has not been resolved by means of the above article will be submitted to the discretion of the Tribunal de Grande Instance de Toulouse.
